Senate Select Committee on Judicial Oversight and Reform
The Senate Select Committee on Judicial Oversight and Reform was formed by Senate President Jason Ellsworth and was active during Montana’s 2023 Legislative Session interim. It’s aim was to address court rulings that struck down bills passed by the Republican-led Legislature and examine whether the judiciary had overstepped its bounds in declaring laws unconstitutional, interfering with the legislative process.
Opposition to the committee came from a range of sources, including Democratic leaders, legal professionals, and advocates for preserving the integrity of Montana’s Constitution and courts. Refusing to take part in the committee, Democratic leaders argued it was a waste of resources and fueled by partisan frustration over court rulings. Others say it represented an unwarranted challenge to the judiciary’s role.
